Terms and Conditions

Welcome to NineSquare. By engaging with our services, you agree to the following terms and conditions. These outline the expectations and responsibilities between you (the client) and NineSquare.

  1. Project Scope & Estimates
  • Project estimates are based on our initial understanding of your needs and desired timeline.
  • Any changes to the scope—whether minor edits or added features—may result in a revised quote.
  • We encourage clear discussions during in-person or virtual meetings to finalize your requirements.
  1. Acceptance of Terms
  • Your acceptance of our quote constitutes agreement with these terms.
  • Approval can be provided via email, verbal confirmation, signed agreement, or payment of any initial deposit.
  1. Client Input & Clarification
  • Clients are responsible for reviewing the proposal to ensure all expectations and functionalities are accurately captured.
  • Any specific conditions or requests must be shared before the project begins.
  • If certain details are not shared in time, we will proceed based on our interpretation. Later changes may result in added costs.
  1. Content Submission & Timeline
  • All required content (text, images, brand assets, etc.) should be submitted within two weeks of project commencement.
  • Delays in submission may impact timelines and may result in additional administrative charges if timelines are exceeded.
  1. Testing & Device Compatibility
  • Our websites are tested on modern versions of Chrome, Firefox, Safari, and Microsoft Edge.
  • We test responsiveness on iPhones and iPads by default. Additional devices or environments must be requested ahead of time.
  1. Hosting & Server Access
  • If your website is hosted on a third-party server (not managed by NineSquare), any technical support related to hosting will be billed separately.
  • Hosting is not included unless explicitly stated in the proposal.
  • Clients managing their own hosting should consult us to ensure compatibility with our development framework.
  • We require full access for deployment and testing purposes. Test sites remain on NineSquare-controlled servers until final payment is received.
  1. Inactive Projects
  • If a project remains inactive for more than 60 days, a maintenance fee of $99 per week may be applied.
  • We may also re-evaluate the original cost estimate depending on how much work remains.
  • Clients must inform us in advance if a project needs to be paused. There’s no fee for placing a project on hold, but an account update is required.
  1. Third-Party Services & Limitations
  • NineSquare may suggest or implement third-party tools and plugins, but we are not liable for their functionality or limitations.
  • Costs for external services (SSL certificates, payment gateways, marketing tools, licenses, etc.) are not included unless specifically quoted.
  • For open-source platforms (e.g., WordPress), clients are responsible for ongoing updates and security maintenance.
  1. Network & Internet Conditions
  • Our websites are built for optimal use on high-speed commercial internet.
  • Performance may vary on local office networks depending on bandwidth and configuration.
  1. Use of Vendors
  • Some service elements may rely on third-party providers. Changes in their offerings or policies may influence delivery timelines or outcomes.
  1. Timelines & Delays
  • We strive to meet project deadlines but are not responsible for delays caused by unforeseen events or external factors.
  • Reasonable efforts will always be made to maintain agreed timelines.
  1. Domains & Add-On Services
  • Unless clearly mentioned, our estimates do not include domain registration, renewals, or DNS setup.
  • If you require help with these services, we’re happy to provide a separate quote.
  1. Ownership & Intellectual Property
  • Once the final invoice is paid, you own the rights to the visual design, text, and images created for your project.
  • However, core development components such as code, scripts, and backend logic remain proprietary unless otherwise agreed.
  1. Communication Protocol
  • All official project communication will take place via email.
  • Clients must keep us updated with their correct contact details to ensure smooth correspondence.
